Terms of Service for docfast

These Terms of Service (“Terms”) govern your access to and use of the docfast software-as-a-service platform (“Service”) provided by PT Kausa Teknologi Indonesia (“we,” “us,” or “our”).

By accessing or using the Service, you (“Customer” or “User”) agree to be bound by these Terms. If you do not agree, you may not use the Service.


1. Definitions

  • Service: The docfast software platform delivered as a cloud-based service.
  • UAT (User Acceptance Testing): The formal testing process performed by the Customer before go-live to confirm the Service meets agreed specifications.
  • Downtime: Any period during which the Service is unavailable to the Customer, excluding planned maintenance, force majeure, or failures outside our reasonable control.

2. Scope of Service

  • We provide access to the Service as described in applicable agreements or order forms.
  • We only provide the software; once UAT is completed and accepted by the Customer, all of our delivery obligations are deemed fulfilled.
  • Any configuration changes, custom development, or professional services requested after UAT acceptance are considered out of scope and may be subject to separate agreements and fees.

3. Service Level Agreement (SLA)

  • We commit to providing the Service with a minimum of 95% uptime calculated on a monthly calendar basis.
  • Downtime does not include:
    • Planned maintenance with reasonable prior notice,
    • Events beyond our reasonable control (e.g., internet backbone failures, DDoS attacks, force majeure).
  • We will use commercially reasonable efforts to minimize downtime and restore service promptly.

4. User Responsibilities

  • Users are responsible for the accuracy and legality of all data submitted to the Service, including but not limited to HS Codes, permit details, and customs documentation.
  • Users must maintain the security of their login credentials and ensure only authorized personnel access the Service.
  • Users are solely responsible for compliance with all applicable customs and trade regulations.

5. Data Ownership and Privacy

  • Customer retains ownership of all data uploaded to the Service.
  • We process and store such data solely to provide and improve the Service, subject to our Privacy Policy (incorporated herein by reference).
  • Upon termination, Customers may request a copy of their data within a reasonable period, after which we may delete or archive such data.

6. Intellectual Property

  • All intellectual-property rights in and to the Service, including software, features, and documentation, remain exclusively with Us.
  • No rights or licenses are granted to the Customer other than the right to use the Service in accordance with these Terms.

7. Acceptable Use

Users may not:

  • Use the Service for unlawful or fraudulent purposes,
  • Attempt to disrupt or compromise the security of the Service,
  • Reverse-engineer, decompile, or attempt to derive the source code of the Service.

8. Support and Maintenance

  • Basic support is provided through designated communication channels during business hours.
  • Response times may vary depending on the nature and severity of the issue.
  • Scheduled maintenance will be communicated in advance whenever reasonably possible.

9. Disclaimers and Limitation of Liability

  • The Service is provided “as is” and “as available.”
  • To the maximum extent permitted by law, we disclaim all warranties not expressly stated herein.
  • We shall not be liable for any indirect, incidental, or consequential damages arising from use of the Service.
  • Compliance outcomes depend on the accuracy of data input by the Customer; we are not responsible for penalties, fines, or losses resulting from incorrect or incomplete data provided by the Customer.

10. Force Majeure

We shall not be held liable for delays or failures caused by events beyond our reasonable control, including but not limited to natural disasters, labor disputes, power failures, or government actions.


11. Termination

  • Either party may terminate the agreement in accordance with the applicable contract or subscription terms.
  • Upon termination, all rights to use the Service shall cease, except as otherwise provided by law or contract.

12. Changes to the Terms

We may update these Terms from time to time.

Material changes will be communicated through email or by posting a notice within the Service. Continued use of the Service after the effective date of the updated Terms constitutes acceptance.


13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Indonesia, without regard to conflict-of-laws principles.

Any disputes shall first be attempted to be resolved amicably; if unresolved, they shall be submitted to the competent courts of Jakarta, Indonesia.
